Islamic & Structured Finance
Appleby has always been a strong supporter of the development of Islamic and Structured Finance. In recent years the practice has become a key and truly global focus for the firm. Appleby is well known in the Middle East, London and elsewhere for its knowledge and depth of expertise. Our lawyers have advised on Islamic Financing transactions: capital market sukuks, securitisations and bank debt financings and all types of funds, whether Shari’ah-compliant or conventional.
Appleby couples its legal expertise in Islamic and Structured Finance with the provision of corporate services, SPV administration, fund administration, and management and accounting services to provide a seamless comprehensive service in each of its offshore jurisdictions of Bermuda, the British Virgin Islands, the Cayman Islands, Guernsey, Isle of Man, Jersey and Mauritius.
We regularly advise on:
- Sukuk
- Murabaha
- Ijara
- Musharaka
- Salam
- Wakala
- Mudaraba
We also regularly advise on the establishment of investment funds and (re)insurance and (re)takaful products in each of our offshore jurisdictions. We have been involved in the execution of both conventional and Shar’iah structures and products, including funds that separate investment management entities as between the Shari’ah and conventional portfolios within the fund.
